These Terms of Use (the “Terms”) govern your use of macmeup.com, the MacMeUp Community at community.macmeup.com, the MacMeUp Store, and the software published by MacMeUp (together, the “Services”). MacMeUp (“MacMeUp”, “we”, “us”, “our”) is an independent macOS software developer. By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

Some parts of the Services have additional terms, which form part of these Terms:

1. Who can use the Services

You must be at least 13 years old (or the minimum age required in your country) to use the Services, and at least 16 to create a Community account in the European Economic Area or the United Kingdom. To make a purchase you must be old enough to enter into a binding contract where you live, or have the permission of a parent or guardian who agrees to these Terms on your behalf.

2. MacMeUp software

Our apps, free or paid, are licensed to you, not sold, under the EULA. Download apps only from macmeup.com or another source we link to; we cannot vouch for copies obtained elsewhere.

System-level tools and guides. Several of our apps and articles deal with low-level parts of macOS, such as boot volumes, the EFI System Partition, boot arguments, System Integrity Protection, Gatekeeper, OpenCore and OpenCore Legacy Patcher, and running macOS on hardware Apple does not support. Changes of this kind can stop a Mac from starting, cause data loss, weaken security protections, affect your Apple warranty or service eligibility, or fall outside the terms of Apple's own software licence. Always keep a current backup, read the instructions in full, and make sure you are entitled to do what you are about to do. You are responsible for the changes you choose to make to your own devices.

4. Community accounts

You can create a Community account with an email address, or sign in through a third-party provider such as Google, Yahoo or Apple. You are responsible for keeping your login details secure and for everything that happens under your account. Tell us promptly at [email protected] if you think your account has been compromised.

Display names and usernames must not impersonate other people, MacMeUp staff or Apple, and must not be offensive. When posting, follow our Community Guidelines.

5. Your content

You keep ownership of the posts, images, files and other material you submit to the Services (“Your Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format and distribute Your Content as needed to run and promote the Services. This licence ends when Your Content is deleted, except for copies kept in backups for a limited time, content other members have quoted, and content we must keep for legal reasons.

You confirm that you have the right to post Your Content and that it does not infringe anyone's rights or break the law. We do not review content before it is posted, but we may edit, hide, move or remove any content, and suspend or close accounts, if we believe it breaks these Terms or harms the Community.

Unless stated otherwise, the Services and their content (text, graphics, logos, app icons, screenshots and software) are owned by MacMeUp or its licensors and are protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use and link to any public page. You may not republish, sell or redistribute our content or software without written permission, except where an article or app says otherwise.

MacMeUp, Bootabler, Mac Tweaks, DeskBridge, ESP Mounter and our other app names and logos are our trademarks. You may not use them in a way that suggests we endorse you or your product.

Apple, the Apple logo, Mac, macOS, MacBook, MacBook Air, MacBook Pro, iMac, Mac mini, Mac Studio, Mac Pro, Finder and Safari are trademarks of Apple Inc., registered in the U.S. and other countries and regions. MacMeUp is an independent developer and is not affiliated with, authorized, sponsored, endorsed or otherwise approved by Apple Inc. All other product names and trademarks are the property of their respective owners and are used for identification purposes only.

If you believe content on the Services infringes your copyright, follow the process in our Copyright & DMCA Policy. We will remove infringing material promptly.

8. Donations

Donations made through the Support page are voluntary gifts that help us keep our free apps and guides available. They do not buy a product, a licence or a service and are not refundable, except where we made a mistake (for example, a duplicate payment) or the law requires a refund.

9. Third-party services and links

The Services link to, embed or rely on third-party websites and services, such as PayPal, Cloudflare, Google, GitHub, Apple and the developers of open-source projects we write about. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

10. Disclaimers

To the fullest extent permitted by law, the Services, our content and our free software are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or secure, or that any app will work with every Mac or every macOS version. Paid software comes with the commitments set out in the EULA and Refund Policy.

11. Limitation of liability

To the fullest extent permitted by law, MacMeUp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, goodwill or business, arising out of or in connection with the Services, even if we were told such loss was possible. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$50.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.

12. Indemnity

If you break these Terms or the law, or Your Content infringes someone else's rights, you agree to compensate MacMeUp for reasonable losses and costs (including reasonable legal fees) resulting from claims brought against us because of it, to the extent permitted by law.

13. Your rights as a consumer

If you are a consumer, you may have rights under the law of the country where you live that cannot be waived by contract. Nothing in these Terms affects those rights.

14. Suspension and termination

You may stop using the Services at any time and can ask us to delete your Community account. We may suspend or end your access to all or part of the Services if you seriously or repeatedly break these Terms, if we are required to by law, or if we stop offering a service. Where we stop selling or supporting a paid product, licences already bought keep working as described in the EULA.

15. Governing law and disputes

These Terms are governed by the laws of the place where MacMeUp's operator is established, without regard to its conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts there. Before starting any formal dispute, please contact us at [email protected] so we can try to resolve it informally.

16. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the “Last updated” date. If a change is significant, we will give reasonable notice on the Site or in the Community, or by email to customers. Changes do not apply retroactively to purchases you have already made.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor who takes over the Services. These Terms, together with the documents they refer to, are the entire agreement between you and us about the Services.
